1. Responsible authority

Scout24 SE, Invalidenstr. 65, 10557 Berlin is the responsible authority for data processing of this Website, which is represented by the Board.

2. General data collection

Every time you access our website, information of a general nature is automatically collected. This information (server log files) includes, for example, the type of web browser, the operating system used, and the domain name of your Internet service provider and similar. This information is technically necessary to correctly deliver the contents of websites requested by you and is mandatory when using the Internet.

We also keep this information for a maximum of 7 days for purposes of misuse detection and tracking.

In addition, we delete or anonymise the usage data, including the IP addresses, immediately as soon as they are no longer required for the aforementioned purposes.

Anonymous data of such kind are statistically evaluated by us to optimise our website and the underlying technology.

The data processing is based on legal regulations that allow data processing because it is necessary for the provision of the website to the user (s. 6(1)(b) DSGVO), or because we have a legitimate interest to ensure the security and functionality of the service and its proper use, without this being contrary to the overriding interest of the persons concerned (s. 6(1)(f) GDPR).

3. Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "Cookies", text files that are stored on your computer and that analyse your website usage. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the US and stored there. However, due to the activation of IP anonymisation on these websites, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. This data transfer is based on EU standard contractual clauses.

On behalf of the operator of this website, Google will use this information to evaluate your website usage, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address provided by Google Analytics as part of Google Analytics will not be merged with other Google data.

You can prevent the storage of cookies by a corresponding setting of your browser software; however, we point out that in this case you may not be able to use all functions of this website in full. The use of Google Analytics is based on our legitimate interest in a needs-based design, the statistical evaluation and the efficient application of our website and the fact that your legitimate interests do not predominate (s. 6 (1) f GDPR).

4. Online application

When submitting an online application, personal data such as name and address, as well as contact and communication data such as telephone number and e-mail address and the documents you provide will be collected for the purpose of processing the application. We store this data for 12 months after completing the application process.

Scout24 SE can keep your application documents and forward them to Immobilien Scout GmbH, Immoverkauf24 GmbH, Flowfact GmbH, Zenhomes GmbH and Upmin Management GmbH provided that you have given us appropriate consent. You can revoke your consent at any time with effect for the future by sending us an e-mail at [email protected]. The revocation of consent does not affect the lawfulness of the processing on the basis of the consent. If you revoke your consent, we will immediately delete your application details, unless the last application process you participated in is closer than 6 months; in such case, we will delete your application data 12 months after completion of the respective application process.

You also have the option to share third-party data with us for your application, such as files stored on your Google Drive account or stored on your LinkedIn profile. If you decide to do so, this information will be provided by the respective provider.

The processing of these data is based on s. 6(1)(a) and b) GDPR and s. 26 (1) Federal Data Protection Act 2018.

Feedback Module
In order to optimise our application procedures, Softgarden will give you the opportunity to provide feedback at various stages of the process. In doing so, the title and location of the position for which you have applied will be recorded. This information, together with your feedback, may be transferred to external partners such as kununu. No personal data will be collected other than the title and location of the position. The transmission of personal data will not take place. The legal basis for this is Art. 6(1) Sentence 1 Point f of the GDPR.

5. Contact form

For inquiries via our contact form, we store your e-mail address and the information you provided for the purpose of processing the request and for possible follow-up questions.

We process this data to answer your request. The data is processed as per legal regulations, which allow the data processing, because it is necessary for the processing of your inquiries (s. 6 (1) (b) GDPR).

After the final answer to your enquiry, we will delete your request and information about its processing with a period of three years after the end of each calendar year.

6. Share Buttons and Google ReCaptcha

Our website uses so-called "Share Buttons", which are links on  various social networks, namely Facebook, Google+, LinkedIn, Xing, Instagram and Twitter. Via these share buttons, no information about the visit of our website is transferred to the respective operator of the social network. Only when you click on the respective share button will you be directed to the page of the network operator. The associated data collections and uses are the responsibility of the operator of the respective social network. Please consult the Data protection of the respective network operator for details.

We also integrate Google ReCaptcha on our website. This plugin is a product of Google Inc (1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA). ReCaptcha is intended to protect against misuse of our offers by checking and preventing interactions on our website through automated access, e.g. through so-called bots. For this purpose, Google processes your IP address and, if necessary, other data that may indicate the presence of human action and which are collected during access to the website.

Processing takes place both within Europe and in the USA, the latter on the basis of EU standard contractual clauses. The privacy policy of Google shall apply, available at www.google.com/intl/de/policies/privacy/.

The abovementioned data processing is based on legal regulations that allow data processing because Scout24 has a legitimate prevailing interest in protecting its IT-systems (s. 6(1)(f) GDPR). Specifically, ensuring the functionality of our offers is to be regarded as a legitimate interest within the meaning of the law.

7. Deletion / Blocking of your data

Unless otherwise stated in this Data protection, we will only store your personal data for as long as is necessary to achieve the purposes stated here or within the framework of a statutory storage period. Thereafter, the data in question is routinely blocked or deleted in accordance with the law.

8. Other disclosures of data

Only in the following cases a transfer of your personal data occurs without your explicit prior permission in addition to the cases referred to in this privacy statement:

  • Personal data is only transferred to law enforcement agencies, as well as, where appropriate, to injured third parties only if it is necessary for the investigation of an unlawful or misuse of the service or for the prosecution. However, this only happens if there are specific signs of unlawful or abusive behaviour. Disclosure may occur even if it serves to enforce Terms of Use or other arrangements. Our legitimate interest in data processing is to ensure the proper functioning of our website and the service and, if necessary, to assert, exercise or defend legal claims.
  • We are obligated by law to provide information to certain public authorities upon request. These are law enforcement agencies, authorities prosecuting fines and the tax authorities.
  • We may occasionally rely on third party contractors and external service providers located outside the EU/EEA, such as when processing online applications, to provide the website functionality described in this Data protection. In such cases, information will be passed on to these companies or individuals for further processing. These external service providers are carefully selected and regularly reviewed by us to ensure that your privacy is maintained and may use the information only for the purposes we have designated. In addition, you will be contractually obliged to treat your data exclusively in accordance with this privacy policy and the German data protection laws. In the case of entities located outside the EU or the EEA, we provide an adequate level of data protection or reasonable guarantees by entering into a contract with the data recipient on the basis of the standard contractual clauses of the EU Commission in accordance with s. 46 (2) (c) GDPR, available under http://ec.europa.eu/justice/data-protection/international-transfers/transfer/index_en.htm.
  • As our business evolves, the structure of our business may change, changing its legal form, establishing, buying or selling subsidiaries, parts of companies or components. In such transactions, the customer information is shared with the part of the business to be transferred. Whenever we disclose personal information to third parties to the extent described above, we will ensure that it is done in accordance with this Data protection and the relevant data protection laws.

9. Right to information / other affected rights

You have the right to receive information about your stored data at any time. Upon presentation of the respective requirements, you may also be entitled to the following rights: 

  • Right to rectification: You are entitled to a correction of false personal data concerning you.
  • Right to cancellation: You may also request the deletion of your personal information, such as when your information is no longer required for the purposes for which it was collected or otherwise processed.
  • Right to restriction of processing: You also have the right to request the restriction of the processing of your personal data; in such case the data will be blocked for any processing. This right exists in particular if the accuracy of the personal data between us is disputed.
  • Right to data portability: If we process your personal information in order to fulfil a contract with you or on the basis of your consent, you also have the right to receive your personal data in a structured, common and machine-readable format, as far as and to the extent that you have provided us with the data.

In addition, you may object to data processing for reasons relating to your particular situation. However, this only applies in cases where we undertake data processing to fulfil a legitimate interest of Scout24 SE or a third party. If you can provide such a reason and we cannot assert any compelling, legitimate interest in further processing, we will not process this data for the respective purpose.

This shall not affect the other rights of objection described in this Data protection.

The offer of Scout24 SE may be changed from time to time, in particular to further improve the functionality of the website. Such changes may also affect the use of your personal information.
